  1. GENERAL - SCOPE OF APPLICATION

(1) The following General Terms and Conditions (GTC) apply to all business relationships between you as a customer and the non-profit Munich Marathon Foundation. The version of these General Terms and Conditions valid at the time the contract is concluded is decisive.

  1. HOW WE CONTRACTS WITH YOU

(1) Our presentation of goods/event registrations on the Internet does not constitute an offer, but a non-binding invitation to you to order these products from us. Your order of the desired products or the event registration via our website and by e-mail is a legally binding offer to conclude a purchase contract.

(2) We will immediately confirm receipt of your order/registration. The order confirmation and the receipt of a telephone order do not constitute a legal acceptance on our part.

(3) By bringing the goods to you for shipment, we accept your offer. If you register for the event, we accept your offer with your entry in the list of participants or with the sending of the invoice to you.

  1. WHAT DOES WHAT COST AND HOW CAN YOU PAY?

(1) The donation and/or the finisher package is paid for by issuing a one-off SEPA direct debit mandate or credit card. Incorrect information provided by the participant and the costs incurred as a result shall be borne by the participant.

(2) You can pay for the goods and, if applicable, repeat orders using a recurring SEPA direct debit mandate or a credit card. All purchase price claims are due at the latest when the additional products ordered are delivered or the starter package is received. In principle, only the methods of payment offered as part of the order are accepted.

(3Participants who do not have a German or Austrian bank account can pay by credit card or through a one-time SEPA direct debit mandate. 

  1. TERMS AND CONDITIONS - DISCLAIMER

(1) If the organizer is obliged to make changes to the execution of the event or to cancel it for safety reasons, without intention or gross negligence on the part of the organizer, in cases of force majeure or due to official orders or for safety reasons, the organizer is not obliged to pay damages to the participant.

(2) The organizer is not liable for damage to property or financial losses caused by him, his legal representatives or his vicarious agents who are not grossly negligent or intentional. The organiser, his legal representatives or his vicarious agents are only liable for damage resulting from injury to life, limb or health if they are at fault.

  1. PARTICIPANT'S CONSENT

(1) Für den Fall meiner Teilnahme am OSTERMARATHON2022 erkenne ich den vorstehend vom Veranstalter formulierten Haftungsausschluss an. 

(2) Prerequisite for participation in this competition is to have trained sufficiently and to be physically healthy.

  1. CONFIRMATION OF PARTICIPATION

(1You will receive a confirmation of participation by email after registering. nach der Anmeldung per E-Mail.  

  1. SECURITY OF ELECTRONIC PAYMENT PROCESSING

(1) The non-profit Munich Marathon Foundation endeavors to provide state-of-the-art procedures for the security of electronic payment processing [currently: Secure Socket Layer (SSL)]. Nevertheless, the non-profit Munich Marathon Foundation assumes no liability for cases of misuse that occur with a money and/or credit card used by the participant for the donation, regardless of whether the participant chooses the safest way of electronic payment processing.

  1. PRIVACY

(1) We take the issue of data protection very seriously and collect, process and use your recorded data in accordance with the provisions of the Federal Data Protection Act and the Telemedia Act. This data can be transmitted to agents and, in accordance with § 11 BDSG, to carefully selected business partners, for example for the purpose of credit checks.

(2) Your data will be saved automatically. 

  1. FINAL PROVISIONS

(1) German law applies exclusively to all agreements between the participant and the non-profit Munich Marathon Foundation, in which these General Terms and Conditions are included, even if the goods are ordered from abroad or delivered abroad. die diese Allgemeinen Geschäftsbedingungen einbezogen sind, gilt ausschließlich deutsches Recht, auch wenn aus dem Ausland bestellt oder in das Ausland geliefert wird. 

(2) If the customer does not have a general place of jurisdiction in Germany or in another EU member state, the place of jurisdiction for all disputes arising from this contract is our place of business. Mitgliedstaat, ist ausschließlich Gerichtsstand für sämtliche Streitigkeiten aus diesem Vertrag unser Geschäftssitz.
